DWARKA EXPRESSWAY Tenders Invited By HUDA by March 07, 2011

HUDA floats tender for Northern Peripheral Road:
After a long delay, the Haryana Urban Development Authority has invited tenders for the much-touted Northern Peripheral Road (NPR).
This stretch will connect Dwarka with National Highway 8 at Kherki Dhaula.

According to the tender document, March 7 is the last date for submission of tenders by private players. The road is being developed under the public private partnership (PPP) model.

The HUDA is expected to open the tenders on March 15.

The detailed document inviting tenders mentions that the project has to be completed within 12 months from the date of awarding of the project.

The NPR stretch has been planned as an alternate link road between Delhi and Gurgaon, and is expected to ease the traffic situation on the Delhi-Gurgaon Expressway.

Sources said that the construction of the peripheral road had been a priority for the state government, considering the major residential and commercial development happening along this corridor.

The road will also provide connectivity to the much-touted Reliance-HSIIDC SEZ besides the Garhi Harsaru dry depot.

A senior government official said, "A lot of time has been lost due to protests from affected property owners on this stretch. Now we want to expedite the work. The infrastructure development is crucial."
The HUDA tender also clearly mentions that the successful bidder will also have the responsibility to maintain the road for five years.

"Maintenance work will include repair of any potholes or depression, removal of all defects such as defective material, bad work man-ship and defective work/design, which will be done by the contractor free of cost. The contractor will be bound to repair road cuts also," the document said.

What is Waiting List in DDA Housing Scheme 2010?

The waiting list will be valid only for 9 months from the date of issue of demand letters to successful applicants. The registration money of the wait listed registrants shall be refunded along with unsuccessful registrants. However, before going for the draw in case the same takes place for filling up the vacancies, all such eligible waitlisted shall be asked to deposit the registration money. 15 days time shall be given to them to do so and only those names shall be included who would be depositing their registration money prior to the draw. A draw will be held only once after six months, from date of issue of demand letters, for allotment of the surrendered flats to the wait listed registrants as per the priority decided initially. Only those flats which are surrendered within six months from date of issue of demand letters would be included for allotment to waitlisted registrants. The waiting list is created just to ensure that the surrendered flats (if any) are allotted to same registrants rather than keeping them vacant and the list will be valid only for 9 months, hence it doesn’t create any right of the wait listed registrants if they fail to get a flat from the surrendered ones. If successful, the cost would be the cost of the fl at on the date the demand cumallotment letter is issued.

DDA to unveil the owners of 16,000 flats in third week of April

Your wait has come to an end if you applied for the DDA Housing Scheme. 7,40,000 people dreamt of owning a DDA flat and registered themselves, but the lucky ones will be only 16,000.

The status of your forms will uploaded on DDA website on 29th March. If there are some corrections that you want to make on the form, you can do so twice.

The names of lucky 16,000 will be uploaded on the website after the DDA 2011 computerised draw.

According to the officials of DDA, most likely the DDA housing scheme draw will be announced on 18th April 2011. (As given on Nav Bharat Times : 13 Apr 2011). DDA is about to organize the DDA Draw Result in Noida

All preparations have been made for the housing scheme draw and all the forms are thoroughly checked. This weekend DDA will advertise about this piece of information in newspapers to inform the people who applied for the DDA Housing Scheme. The advertisement will provide with the relevant information about how to use website to know the information and what to do after that. On 29th March DDA will update their website with the list of correct forms which will include Form number, name of the person, and the amount paid. If any wrong name or wrong amount is entered in front of your form number then it can be corrected by bringing to the notice of DDA office. According to the sources, DDA will provide with 6 days of time for appliers to identify for such mistakes and change it to the original. 3 days after that DDA will update the final list of forms on their website.

What are the different home loan options available to NRIs from Indian Banks:

Many organized banks and HFCs, offers home loans to NRIs and PIOs taking into account their expectations and choice on the type of loan they require. This is good news for NRIs and PIOs who would like to invest their hard earned money back in their home country. A significant number of financial institutions have designed various home loan schemes to ease the norms and bring to reality, the NRI dream homes. Banks and other corporates are waking up to meet the demands of the NRIs, who look for the best service provider to fulfill their cherished dream. With the realty sector booming rapidly and investors growing more knowledgeable in the field of investments, banks and financial companies are competing to extend the most viable home loan options to the their customers.

SBI offers home loans to NRIs employed abroad for atleast two years, with a valid work permit and passport. NRIs with the minimum age of 21 years having minimum net monthly income (NMI) of US$ 500 or minimum Net Annual Income (NAI) of US$ 6000/- can avail the home loan.

It offers a minimum loan amount of Rs 3 lakhs and the maximum loan eligibility based on, 48 times NMI/4 times NAI for applicants below 45 years of age and 36 times NMI/3 times NAI for applicants above 45 years of age. Maximum loan amount for repairs and renovation, purchase of plot for construction, purchase of furnishings and consumer durables amounts to Rs 10 lakh, 20 lakh and 3 lakhs respectively. Maximum repayment period for the loan amount varies as 20 years for borrowers aged upto 45 years and 15 years for borrowers aged 45 and above. SBI offers innovative home loans, which include Maxgain home loan, Flexi home loan, Realty home loan, freedom home loan to lure the NRIs investment. Interest is applied on daily diminishing balance basis and interest rates remain the same as granted to the residents. Repayment can be made by way of EMI.

Country’s second largest lender, ICICI bank grants home loan facility to any NRI having minimum qualification of graduate with minimum 3 years of employment abroad and professional qualification with one year of employment abroad.

Loan against residential property is 85 per cent of the cost of the property, upto 15 years for salaried and 10 years for self-employed, loan against purchase of land and against existing residential property is 75 per cent of the total cost of the property subject to the maximum of INR 50 lakhs, upto 10 years for both salaried and self-employed while it is 60 per cent of the total cost of property upto 15 and 10 years for salaried and self-employed.

Maximum and minimum loan amount it offers is Rs 1 crore and Rs 5 lakh respectively and minimum loan against property is Rs 10 lakh.

HDFC, bearing 25 years of experience in lending home loans have devised a complete package for NRIs. For home loan and home improvement loan, it finances upto 85 per cent maximum of the cost of the property and 70 per cent for land purchase loan. Flexible repayment options are made available with the investor choosing either the fixed or floating interest rates based on their loan structure.

Home loans can be repaid by way of EMI, directly from the bank savings account, by giving a standing instruction to the banker. The Bank also looks into ‘In-house scrutiny of Property documents,’ to ensure safety of investment. It grants customer privilege loan to an existing customer with lower interest rates.

Ashish Gupta explains how this scheme works for young borrowers the repayment of a home loan is through equated monthly instalments (EMIs). Some banks provide the step-up EMI facility to borrowers. The step-up EMI facility reduces the repayment burden in the initial years and helps in increasing the loan eligibility of the applicant. It helps young borrowers, especially those who intend to borrow early but do not have a high income and cannot afford higher EMIs in the initial years.
Later, over time, as the income increases, they can afford to pay higher EMIs. In this process, the borrower takes on a higher interest rate risk if the loan is based on a floating rate of interest. A rise in the interest rate would mean a portion of the total interest would remain unrealised and added to the borrower's principal.

Since a large part of the initial installments go towards interest payment, the borrower can avail of tax benefits for a longer period. Interest on the loan is a cost. However, the tax benefits reduce the cost of borrowing. This way, the borrower can deploy his savings into other investments schemes that offer a better rate of return. In this scheme, the EMI portion is recovered in parts. During the first few years, a lower EMI amount is to be paid by the borrower. During the latter part of the loan tenure, EMIs are increased, so that a higher EMI amount is payable during the later years. This way, the burden of repayment in the initial years is reduced for the borrower. The lower EMI is made possible because of the step-up facility where the monthly payouts increase during the later part of the loan tenure.
The principal repayment under a step up loan may start immediately, thereby reducing the interest rate risk for the borrower. In other cases, the EMIs for the first few years are just enough to cover the current interest rate. The process of step up can be in different phases. In some cases, two phases are offered - one at a lower rate and the other at a higher rate. In other cases, the step-up can be a gradual process. It can be done yearly or every five years, or at some other time periods. Some banks also offer the step-up scheme with a fixed interest rate, but the rate of interest for such loans is higher than the floating rate. Borrowers need to remember, in a step-up scheme, the interest rate risk exposure is quite high. In the initial years, the interest component is more and the principal component is lesser. Lower EMIs in the initial years would mean lower principal amount is being repaid. This deferral of principal repayment to the later part of the loan tenure increases the interest cost of the loan. This may turn out to be higher in case of a floating rate loan, because in case the interest rate increases, a higher rate would have to be paid on a higher outstanding principal loan amount.
In case of a rise in the interest rate, the difference is recovered through higher EMIs towards the end of the loan tenure. Borrowers who are likely to earn more in future can avail this facility to get a higher loan amount and adjust their cash flows over a period of time.

Answer: Almost all lenders charge certain administrative or processing fees apart from interest for providing a home loan in India . You must compare all these charges as well before signing on to a home loan contract.
• Legal fees - payable to the lender or to the legal consultants of the lender
• Technical or Valuation charges - payable to the lender or to his technical consultant.
• Stamp duty on creation of mortgage - some banks charge this fee whilst other banks normally just have a clause that requires this to be paid in the event the state government actually charges this amount. The escape route for non-payment of this duty are progressively being eliminated and the fact that the consumer carries the liability to pay this duty in the future if demanded by the state government along with interest and penalties in the future. So, this should not really be used by a consumer to eliminate a lender just because he is paying this stamp duty to the government.
• Prepayment Charges - This is the biggest charge that most consumers miss taking into account. A loan can be prepaid either in part or in full at any given point of time. You can also prepay a loan even when it is only partly disbursed. However, most banks have an upper limit on the number of times a person can prepay his loan in a year as well as on the minimum amount you can prepay each time. Until recently, banks charged a penalty for part or full prepayment. Increased competition has forced most banks to allow repayment without any charges if it is funded from own sources. In case the borrower, is transferring the loan to another lender he will need to pay the full charges.

Q19. What are the tax benefits that I can avail of for repaying a home loan ?
Answer: You will be eligible to claim both the interest and principal components of your repayment during the year.
• Interest can be claimed as a deduction under Section 24. You can claim up to Rs. 150,000 or the actual interest repaid whichever is lower. (You can claim this interest only when you are in possession of the house)
• Principal can be claimed up to the maximum of Rs. 100,000 under Section 80C. This is subject to the maximum level of Rs 100,000 across all 80C investments.
• You will need to show the statement provided by the lender showing the repayment for the year as well as the interest & principal components of the same.

Q20. Can I take advantage of tax benefits from a home loan as well as claim House Rent Allowance (HRA) ?
Answer: If you took a home loan and are still living in a rented place, you will be entitled to:
1. Tax benefit on principal repayment under Section 80C
2. Tax benefit on interest payment under Section 24
3. HRA benefitOf course, you can claim tax benefits on the home loan only if your home is ready to live in during that financial year.

Once the construction on your home is complete, the HRA benefit ss. If you took a home loan, got possession of the house, have rented it out and stay in a rented accommodation, you will be entitled to all the three benefits mentioned above. However, in this case, the rent you receive would be considered as your taxable income.

Q21. I have a home loan in which I am a co-applicant. However, the total EMI amount is paid by me. What is the total income tax exemption that I can avail of ? Answer: Yes, you can claim income tax exemption if you are a co applicant in a housing loan as long as you are also the owner or co owner of the property in question. If you are only person repaying the loan, you can claim the entire tax benefit for yourself (provided you are an owner or co-owner). You should enter into a simple agreement with the other borrowers stating that you will be repaying the entire loan. If you are paying part of the EMI, you will get tax benefits in the proportion to your share in the loan.

Q22. I have two housing loans on two different properties. Can I get tax rebate under sec 80 C of both the loans?
Answer: Yes, you can get the 80C benefit on both loans. However, the total amount that you will be entitled to will be a total of Rs 100,000 across both the homes.The interest paid on a home loan is not directly deductible from your salary income for either of your flat loans. Income from house property will be calculated for each flat you own. If either of theses calculations shows a loss, this loss can be set off against your income from other heads.As for Section 24 deduction, on your self occupied house you can take advantage of interest payments up to Rs.1,50,000. For the other property, you can claim actual interest repaid, there is no limit for the same.
Q23. Is the EMI amount or the tenure of the loan affected if the value of the underlying property falls ?
Answer: Fluctuating value of the property does not affect your EMI or your home loan liability. If you fail to repay your home loan you will be damaging your credit profile and any chances of getting a loan in the future. In such a case, where you want to dispose of the property because of loss in value – you will be much better off if you prepay your home loan and then sell the property.

Q24. Is it necessary to get property insurance, while availing a home loan ?
Answer: Most lenders do not insist on a property insurance when disbursing a loan. However, it is strongly advised to buy an insurance as your home would be one of your most valuable assets. The home insurance rates are very affordable especially when bought for a long duration say 10 years. It would cost close to Rs. 50 per lakh of property value per year.

Q25. Can I sell the property, even when the home loan is outstanding ?
Answer: Yes, you can sell the property with the consent of the lender. This consent letter usually mentions the amount at which the home loan can be considered fully paid off. This amount is inclusive of prepayment charges as applicable and calculated at a future date to give you enough time to find a buyer. Based on this letter, you can negotiate with potential buyers.If the buyer, wants to take a loan to purchase the property the process is much simpler if he approaches the same lender. Then the lender does not need to release the title papers to another lender before getting the payment.If the buyer wants to make an outright payment- he can make the payment out to the bank directly based on the consent letter. And the balance amount is paid out to you. The property papers will be released only after the bank has recovered the entire amount including prepayment charges.

Q26. Can I increase or decrease the amount of the loan even after it has been sanctioned ?
Answer: Yes, the change in amount can be done at any point before disbursement. Any increase in loan amount will however be subject to the eligibility conditions. The bank might also charge you excess fees on requesting an increase in the loan amount. The bank is not obliged to return excess fees paid in case you are requesting for a reduction in the loan amount.

Answer: Please be clear on why you wish to change your loan provider?

An Indian Citizen who stays abroad for employment/carrying on business or vacation outside India or stays abroad under circumstances indicating an intention for an uncertain duration of stay abroad is a non-resident. (Persons posted in U. N. Organizations and officials deputed abroad by Central/state Government and Public Sector undertakings on temporary assignments are also treated as non-residents). Non-resident foreign citizen of Indian Origin are treated on par with non-residential Indian Citizen (NRI’s) for the purpose of certain facilities.

2. Who is a person of Indian Origin?
For the purpose of availing of the facilities of opening and maintenance of bank accounts and investments in shares/securities in India. A foreign citizen (other than a citizen of Pakistan or Bangladesh) is deemed to be of Indian Origin, if, he, at any time, held and Indian Passport, or he or either of his parents or any of his grand parents was citizen of India by virtue of the Constitution of India or Citizenship Act, 1955 (57 of 1955). Note: A spouse (not being citizen of Pakistan or Bangladesh) of and Indian citizen or of a person if Indian Origin is also treated as a person of Indian origin for the above purposes provided the bank accounts are opened or investments in shares/securities in India are made by such persons only jointly with their NRI spouses. For investments in immovable properties. A foreign citizen (other than a citizen of Pakistan, Bangladesh, Afghanistan, Bhutan, Sri Lanka or Nepal), is deemed to be of the Indian Origin if he held and Indian Passport at any time, or he or his father or parental grand-father was a citizen of India by virtue of the (Constitution of India or the Citizenship Act, 1955(57 of 1955).

They are required to file a declaration in form IPI 7 with the Central Office of Reserve Bank at Mumbai within a period of 90 days from the date of purchase of immovable property or final payment of purchase consideration along with a certified copy of the document evidencing the transactions and bank certificate regarding the consideration paid.

7. Does such property can be sold without the permission of Reserve Bank?
Yes, Reserve Bank has granted general permission for sale of such property. However whether the property is purchased by another foreign citizen of Indian Origin, funds towards the purchase consideration should either be remitted to India or paid out of balance in NRE/FCNR accounts.

8. Can sale proceeds of such property if and when sold be remitted out of India?
In respect of residential properties purchased on or after 26th May 1993, Reserve Bank considers applications for repatriation of sale proceeds up to the consideration amount remitted in foreign exchange for the acquisition of the property for two such properties. The balance amount of sale proceeds if any or sale proceeds in respect of properties purchased prior to 26th May 1993, will have to be credited to the ordinary non-resident rupee account of the owner of the property.

9. Are any conditions required to be fulfilled if repatriation of sale proceeds is desired?
Applications for repatriation of sale proceeds are considered provided the sale takes place after three years from the date of final purchase deed from the date of payment of final installment of consideration amount, whichever is later.

10. What is the procedure for seeking such repatriation?
Applications for necessary permission for remittabnce of sale proceeds should be made inform IPI 8 to the Central Office of Reserve Bank at Mumbai within 90 days of the sale of the property.

11. Can foreign citizen of Indian Origin acquire or dispose of residential property by way of gift?
Yes. Reserve Bank has granted general permission to foreign citizen of Indian Origin to acquire or dispose of properties up to two houses by way of gift from or to a relative who may be an Indian Citizen or a person of Indian origin whether resident in India or not, subject to compliance with applicable tax laws.

12. Can immovable property held in India, be transferred by way of gift to relatives/registered charitable trusts/organizations in India?
Yes. General permission has been granted by Reserve Bank to non-resident persons(foreign citizen) of Indian Origin to transfer by way of gift immovable property held by them in India to relatives and charitable trust/organizations subject to the conditions that the provisions of any other law, including Foreign Contribution (Regulation) Act, 1976, as applicable, are duly complied with.

13. Can foreign citizen of Indian Origin acquire commercial properties in India?
Yes. Under the general permission granted by Reserve Bank properties other than agricultural land/farm house/plantation property can be acquired by foreign citizen of Indian Origin provided the purchase consideration is met either out of inward remittance in foreign exchange through normal banking channels or out of funds from the purchaser's NRE/FCNR accounts maitained with banks in India and a declaration is submitted to the Central Office of Reserve Bank in Form IPI 7 within a period of 90 days from the date of purchase of the property/final payment of purchase consideration.

Yes. 16. Can the properties(residential/commercial) be given on rent if not required for immediate use?
Yes. Reserve Bank has granted general permission for letting out any immovable property in India. The rental income or proceeds of any investment of such income are eligible for repatriation.

17. Can NRI’s obtain loans for acquisition of house/flat for residential purpose from authorized dealers/financial institutions providing housing finance?
Reserve Bank has granted general permission to certain financial institutions providing housing finance e.g. HDFC, LIC Housing Finance Ltd., etc., and authorized dealers to grant housing loans to non-resident Indian nationals for acquisition of a house/flat for self-occupation subject to certain conditions. The purpose of the loan, margin money and the quantum of loan will be at par with those applicable to housing loans to residents. Repayment of loan should be made within a period not exceeding 15 years out of inward remittance or out of funds held in the investor's NRE/FCNR/NRO accounts.

For example, the contract was for A to purchase a piece of land from B for Rs 20,00,000, to be paid in 5 monthly installments. If A makes the first two payments, but fails to make the third payment, an acceleration clause would require that A must immediately pay B the entire balance, or lose his right to purchase (without getting a refund of his 8,00,000).

The biggest and most costly mistakes that Landlords make:

1. They haven't read, nor are they familiar with their landlord-tenant laws.
Unfortunately, too many people never take the time to do so and it ultimately will come back to bite them. But we get it. Read it. Know it - Not to mention we have experienced lawyers/advocates in our panel who are well experienced in handling such matters.

2. They do not conduct credit, background, and former residence checks.
One would think this would be a high priority, but to many it is not nor do they have the access to do a thorough screening. Not only is credit history, rental history and employment verification important, but have you ever considered that you should also learn if the applicant is on the terrorist list or have no poteial link to such terrorist or antisocial organization? 3. They do not run their rentals like a business.
The fact of the matter is when your property becomes a rental, it is a business and only those who treat is as such will truly be successful.

4. They are poor record keepers.
This tie in with number 3. Sloppy records lead to poor profits, and possible trouble with tenants and laws. AGR uses industry specific software creating detailed monthly statements and annual accounting.

5. They do not perform preventive maintenance.
Waiting until something breaks down before it gets the landlord's or renter's attention is expensive, time-wasteful, and inconvenient for all involved. It doesn't take much to do routine maintenance and AGR stays on top of things most often overlooked.

6. They jump into property management without knowing anything about it.
